Malang, FH UB – The Student Organization Law Student Forum Concerns Justice at the Faculty of Law, Universitas Brawijaya (FORMAH PK FH UB), held a 2023 Legal Counseling in Simojayan Village, Ampelgading District, Malang Regency, on Friday, June 2, 2023.

This legal counseling program is a superior work program for FORMAH PK FH UB, which collaborates directly with the Student Affairs of FH UB. This activity was held in the context of increasing understanding of community law as an effort to realize inclusive agrarian reform in order to achieve land redistribution based on justice and prosperity, especially for the people of Simojayan Village.

The Chief Executive for Legal Counseling, Jonathan Pascal, said that this legal counseling was carried out routinely every year in villages whose people had legal problems.

On this occasion, Dr. Aan Eko Widiarto, S.H., M.Hum. (Dean of FH UB), Dr. Muktiono, S.H., M.Phil. (Vice Dean III of FH UB), and Dr. Herlindah, S.H., M.Kn. (Lecturer at FH UB), as well as several community elements, starting from the Head of Simojayan Village, the Indonesian Farmers Alliance (API), to the National Land Agency for East Java Regional Office and Malang Regency, were attending this legal counseling program.

In the Dean’s remarks, Dr. Aan Eko Widiarto, S.H., M.Hum., said that this legal counseling was very special because it directly involved local farmers.

“The 2023 Legal Counseling is quite special because it also invites representatives from the Indonesian Farmers Alliance (API),” said Dr. Aan Eko Widiarto, S.H., M.Hum., in his speech.

The Chief Executive, Jonathan Pascal, when giving his speech also said that the residents of Simojayan Village were faced with many problems in the land sector, so this prompted FORMAH PK to hold legal counseling on the land.

“Several residents in Simojayan Village have problems with land certification, so our goal is to hold a large legal counseling session in this village to provide knowledge to the community so that they can later move independently to solve their problems armed with the information obtained from this activity,” said Jonathan Pascal, an undergraduate student in the class of 2021 at FH UB.

Jonathan Pascal also said that FORMAH PK had conducted a survey of several villages in Malang Regency before finally choosing Simojayan Village as the location for legal counseling. Out of the approximately 30 villages examined, the Simojayan Village community was fairly cooperative in assisting with research on legal issues in the village by filling out a questionnaire that had been provided by the implementing committee. Thus, the committee decided to choose Simojayan Village as a location for legal counseling purposes.

In the presentation on the condition of Simojayan Village, it is known that the majority of the people in Simojayan Village own land, but the land does not have certification. Based on the data, about 80% of the land owned by villagers is hereditary land, and some of it was formerly owned by PT. Perkebunan Nusantara (PTPN).

Reinhart Samuel said that the majority in Simojayan Village own land, but the land does not have land certification, so one method must be carried out, one of which is land redistribution. The land redistributed has a legal basis and certainty.

A Lecturer of Agrarian Law at FH UB, Dr. Herlindah, S.H.M., M.Kn., explained during a legal counseling presentation that determining the subject of agrarian reform requires analyzing data regarding who owns it, what it has been used for, and what the limits are. After that, the government designated it as Land for the Object of Agrarian Reform (TORA), so that it could then be determined who had the right to distribute the land.

At the end of the presentation, representatives of the Simojayan Village community emphasized that by holding this legal counseling, in the future, they hope that the Simojayan Village community would be able to have land title certificates.
